Supreme Court Hands Ed Sheeran Legal Win In Marvin Gaye Copyright Fight
The U.S. Supreme Court has declined to hear a copyright case accusing Ed Sheeran of copying Marvin Gaye’s 1973 hit “Let’s Get It On” in his 2014 song “Thinking Out Loud.” The lawsuit was brought by Structured Asset Sales (SAS), which owns part of the rights to Gaye’s song. SAS claimed Sheeran used the song’s melody, harmony, and rhythm. However, a federal judge dismissed the case in 2023, ruling the musical elements were too common to be protected by copyright. That decision was upheld by the 2nd U.S. Circuit Court of Appeals, and now the Supreme Court’s refusal to review the case ends the matter in Sheeran’s favor.
